OF PARTICIPATION – YOU TRY IT, YOU RATE IT PROMOTION

•	Registration for the “You Try it, You Rate it” promotion (“the Promotion”) is open to all residents of Australia except ACT residents. The Promoter is XYZnetworks Pty Limited (ABN 71 066 812 119) of Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 (the “Promoter”). These Terms of Participation form part of the conditions of entry. Entry into the Promotion is deemed acceptance of these Terms of Participation.

•	The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with the Promotion, FOXTEL or AUSTAR and their related bodies corporate are not eligible to enter.

•	The Promotion begins at 12:01 am (AEDT) on 12/03/10 and closes at 11.59pm (AEDT) on 18/03/10 (the “Promotion Period”).

•	Depending on the number of products available to review, a pre-determined number of people who have registered for the Promotion will be randomly selected to review a product or experience (a “YOU Reviewer”). The YOU Reviewers will be randomly selected by Red Promotions ABN: 18 204 124 053 of 8/63 Bream St, Coogee, NSW, 2034. By entering the Promotion, entrants agree to have their personal information passed onto Red Promotions for the purpose of selecting the YOU Reviewers.

•	To become a YOU Reviewer, entrants must:

(a)	Register online at www.lifestyleyou.com.au;
(b)	Become a member of LifeStyle YOU;
(c)	Specify which product you would like to have the chance to review;
(d)	Fulfil the age or other criteria specified for the product you have selected; and
(e)	If chosen as a YOU Reviewer, complete a written review of the product or experience being offered (“Product Review”).

Entrants who become a member of LifeStyle YOU will have the choice to receive promotional material from LifeStyle YOU including, but not limited to, electronic newsletters. Entrants can unsubscribe from the promotional materials at any time by following the unsubscribe prompts.

Entrants who enter the Promotion also agree that if they are selected as YOU Reviewers, their personal information and Product Reviews will be passed onto third party suppliers of the products for the purpose of those third party suppliers distributing the products to the YOU Reviewers. The Promoter accepts no responsibility for any other use of the YOU Reviewer’s personal information by these third parties.

•	All entries must include the entrant’s name, residential address (PO boxes will not be accepted), postcode, daytime phone number (including area code), mobile phone number, email address and date of birth to be eligible for the Promotion. Incomplete entries will be ineligible. It is the entrant’s responsibility to inform the Promoter if their residential address or contact number changes during the Promotion Period.

•	Entrants can enter for each product as many times as they like, but will only be eligible to review one of each product.

•	There are 12 products to be reviewed in total, consisting of:

•	1 family getaway including; two nights accommodation for 2 adults and 2 kids at Silverwater Resort for a family (2 adults & 2 kids), a 3 Parks Pass with Penguins Plus upgrade – allowing entry into all of the Phillip Island Nature Parks attractions which include the Penguins Parade, Churchill Island Heritage Farm and the Koala Conservation Centre, a Wildlife Cruise to see Australia’s largest colony of fur seals at Seal Rocks and a $100 lunch / dinner voucher to the Nobbies Centre, all valued at up to $500. Conditions apply, subject to availability. Winner must live near or be willing to travel to Phillip Island, Victoria to be elegible.
•	2 DVD packs, valued at $239.85 each. Not valid for winners under 15 years of age.
•	7 Grapefruit + Jojoba Reeds, valued at $79.95 each.

•	2 x 6 hour deluxe cleaning packages, valued at up to $317 each. Restrictions – winner must be within 25km radius of Sydney City.

(“Products”)

The total maximum value of the Promotion is $2173.35 (including; 2 DVD packs, valued at $239.85 each, 7 x Reeds, valued at $79.95, 2 cleaning packages (within 25 km radius of Sydney), valued at up to $317, and 1 family holiday to Phillip Island, valued at up to $500 – conditions apply, see advertised copy for details). The product values are the recommended retail values as provided by the suppliers and are correct at the time of printing on the LifeStyle YOU website. The Promoter is neither responsible nor liable for any change in the value of the products occurring between publishing date and the date the product is distributed.

•	The Products are not transferable or redeemable for cash. The Products or any element of the Products cannot be exchanged for any other Product/s. The contents of the Products will be at the Promoter’s sole discretion. The Products are subject to availability and the terms and conditions of the entities supplying the Products. In the event that a Product becomes unavailable, for whatever reason, the Promoter reserves the right not to substitute the Product for an alternative Product/s.

•	Those entrants who are selected to be a YOU Reviewer will be notified by an electronic card (ecard) sent to the YOU Reviewer’s email address at or around 5.00pm (AEDT) on 19/03/10.

•	Following notification by the Promoter (or the Promoter’s agent) that an entrant has been selected as a YOU Reviewer, the supplier will endeavour to send the Product to the YOU Reviewer at the YOU Reviewer’s nominated residential address within 21 days, subject to any special provisions relating to the Product.  If a selected YOU Reviewer cannot be contacted or the Promoter is unable to deliver the Product to the YOU Reviewer, then the Product will not be offered to the YOU Reviewer for the purposes of a Product Review.

•	It is a condition of accepting the Product to review that the YOU Reviewer must comply with all the conditions of use of the Product and Product supplier’s requirements. Each Product must be taken as stated and no compensation will be payable if a YOU Reviewer is unable to use the Product as stated.

•	YOU Reviewers must submit a valid review to the LifeStyle YOU website via the link provided on the confirmation ecard or by following the links on the LifeStyle YOU website within 14 days of receiving the Product in order to be eligible to review any future products. YOU Reviewers who do not satisfy review requirements by the stipulated date will be removed from the validated reviewing list immediately. No responsibility will be taken by the Promoter for any changes in dates, times or cancellations or other arrangements that may prevent the YOU Reviewers from reviewing the Products.

•	The Promoter, or the Promoter’s agent, will select a maximum of three Product Reviews for each Product (at its sole discretion) which will be published on the LifeStyle YOU website and otherwise communicated to the public in any media by the Promoter. Any Product Review which contains defamatory, offensive, pre-used or copyrighted material will be ineligible for publication and those YOU Reviewers will be removed from the validated reviewing list immediately.

•	By submitting a Product Review, each participant warrants that their entry is their own original work, and that they own all rights, including copyright, in their entry. Each participant indemnifies the Promoter in the event that this warranty is false.

•	YOU Reviewers acknowledge that all entries and all Product Reviews become the property of the Promoter and may be communicated to the public by the Promoter or used for promotional purposes in any media at any time. By entering the Promotion, entrants agree to the use of their name, Product Review, image and/or photograph without compensation and agree that the Promoter will own copyright in any such images, Product Reviews and/or photographs.

•	Some Products may require an element of travel, for example if a YOU Reviewer is required to do a Product Review for a spa treatment. All ancillary costs incurred in taking and using such Products (including, but not limited to, travel and meals) are the responsibility of the YOU Reviewer, unless expressly stated as being part of the Product.

•	Entrants who are under 18 years of age are required to check the descriptions of the Products on the Lifestyle YOU website (www.lifestyleyou.com.au) for details of any age restrictions which may apply to particular Products. Entries received from participants who are under the age of 18 for Products which do have age restrictions will be ineligible to be a YOU Reviewer.

•	All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as a YOU Reviewer or if reasonably requested by the Promoter or the Promoter’s authorised agent. In the event that a YOU Reviewer cannot provide suitable proof, the YOU Reviewer will forfeit the chance to receive the Product and/or provide a Product Review.

•	No responsibility will be taken by the Promoter, LifeStyle YOU, FOXTEL, AUSTAR or Optus TV for any changes in dates, times or cancellations or other arrangements that my prevent a participant from becoming a YOU Reviewer.

•	It is a condition of entering the Promotion that those participants selected to be YOU Reviewers may required to sign a legal release in a form determined by the Promoter in its absolute discretion.

•	The Promoter reserves the right, in its absolute discretion, at any time during the Promotion, to cancel or vary the terms of the Promotion or the contents of the Products, including without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion):

(a)	a participant/YOU Reviewer does not satisfy the Promotion entry requirements; or
(b)	the Promoter cannot conduct the Promotion for any reason beyond its control.

•	In the event that the Promoter cancels or varies the Promotion, it shall not:

(a)	be liable to any person for any loss or damage (including loss or damage caused by negligence) arising out of, or in connection with such cancellation, variation or withdrawal; and
(b)	be required to conduct the Promotion at any other time.

•	Any decision by the Promoter in relation to the conduct of the Promotion is binding and conclusive and no correspondence will be entered into.

•	Entrants enter the Promotion at their sole risk. To the extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever suffered, including but not limited to direct or consequential loss or personal injury suffered or sustained by any participant and/or YOU Reviewer during the course of the Promotion or in connection with any use of the Products.

•	YOU Reviewers agree to release and hold harmless the Promoter and its subsidiaries and affiliates, and each of their respective parent companies and each such company's officers, directors, shareholders, employees and agents from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of use of or participation in any Product as part of this Promotion.
